Is It Safe to Use AI to Apply for Jobs in 2026?

A federal court is testing AI screening in hiring. What that case says about applicants, and how to use AI without sending answers you never gave.

Maximilian Simkins5 min read

It can be, if the tool only sends answers you gave or approved and you can see what it sent. The litigation that makes headlines right now is about employers' AI screening applicants, not applicants using AI to fill forms. The risk on your side is simpler: an application that says something you never told anyone, and no record of what was submitted.

This is general information, not legal advice.

What just happened in court?

On October 7, 2026, a federal magistrate judge in San Francisco issued a discovery order in Mobley v. Workday, Inc., a long-running case about AI applicant screening. The order describes the case as one where "[t]he plaintiffs in this conditionally certified ADEA collective action claim that Workday's applicant-screening tools discriminate against job applicants who are forty and older." It adds that "more than 15,000 people have opted into the ADEA collective." The plaintiffs moved for class certification on September 14, 2026.

Nothing in the order decides whether the claims are right. It sets rules for how Workday may question people who signed sworn statements for the plaintiffs.

Does this case say anything about applicants who use AI?

No. The order is about a vendor's screening tools and the applicants it allegedly screened out. It says nothing about applicants who use software to fill forms. If you read a headline that makes the case sound like a warning to job seekers, check it against the order.

What the case does show is how much an applicant's own history matters once a dispute starts. The order describes the sworn declarations as ones where each "recounts the declarant's job-application history, experience and qualifications, and interactions with Workday's platform." That is a reasoning point of mine, not the court's: if you ever need to explain what you applied to and what you said, a record helps.

What does a safe AI application tool look like?

Three things matter more than the AI itself:

Question to askWhy it mattersWhat Morrow says it does
Who picks the jobs?A tool that applies on its own can send applications you never wanted. You pick jobs on your phone. "Morrow never applies to a job you did not pick."
Where does each answer come from?An answer nobody gave is the real risk.Every answer comes from your saved answers, your resume, or an approval you gave for that field.
What happens when the form asks something it can't answer honestly?Guessing is how false answers happen. It stops and asks you. Support calls this "the product working right."
Can you see what was sent? You can't dispute or correct what you can't see.Every submission has a receipt: a screenshot, a record, and a link to pull it back.
Where does it run?Mass-apply tools often work through job boards' quick-apply buttons.A worker app on your own computer fills out the form. "Never LinkedIn Easy Apply."

Morrow's worker app runs on Mac and Windows.

How does Morrow handle a question it can't answer?

It parks the application and asks you. Morrow's support page says that when a form asks something it can't answer honestly, it "stops and asks you instead of guessing," and that answering in the app lets it pick back up. Parked or refused jobs do not count against your daily or monthly quota.

What is the Nothing-False Guarantee?

It is Morrow's refund promise about invented answers. Under the published terms, if Morrow submits an answer you did not provide or approve, that billing month is refunded. A violation is a value in an answer field that cannot be traced to your saved answer bank, the resume on file, or an approval you gave for that specific field on that specific job.

Limits, in the terms' own words: an answer you approved, including in Auto Mode, is not a violation even if you later regret it. Errors the employer's system introduces after submission are not covered either. You have 90 days to file a claim, with one refund per billing month. The guarantee is a refund of the month's fee, and the terms say it does not cover other damages or losses.

Is review mode or auto mode safer?

Review is stricter, because you see the answers first. The First Interviews plan is review only. The Full Send and The Interview Engine offer review or auto mode. In auto mode, approvals you already gave still apply, and the terms are clear that an approved answer stays your answer.

What does the court case teach about keeping records?

PUBLIC CASE

This is a public case, not one of our engagements.

In Mobley v. Workday, Workday noticed thirty-eight depositions of people who had given declarations for the plaintiffs. The court's October 7 order let Workday depose fifteen: "Workday may depose fifteen declarants that it selects, for two hours each, remotely, limited to the contents of the declarations, between October 15 and 30, 2026, on dates set by agreement of the parties." The court explained: "A party that offers a witness's sworn statement on a contested motion must expect that the witness will be cross-examined."

It also found that each declarant had "answered Workday's written discovery" and described the declarations as "structurally similar." What changed for the people involved is practical: their application histories are now subject to questioning under oath, on a schedule set by a court. What it means for you is narrower. Most job seekers will never be in a lawsuit, but anyone who applied by the hundreds may someday need to say what they submitted and when. A per-job receipt answers that without memory. The order does not say anything about receipts or about AI tools used by applicants.

What should you check before trusting any auto-apply tool?

  • It applies only to jobs you chose.
  • It can show you a record of every submission.
  • It refuses or asks when it lacks an answer, instead of filling in something plausible.
  • It states a remedy if it sends something false, and the remedy has stated limits you can read.
  • It lets you cancel without a call. Morrow's terms say cancelling stops future charges and your plan stays active until the end of the period you paid for.
